Judge chastises Trump administration plan to push ahead overhaul of DC golf course
Heard on All Things Considered In a tense hearing on Monday, federal Judge Ana C.
Ana C.
Reyes sharply rebuked administration lawyers over President Trump's apparent intent to defy the court and proceed with a major renovation of the historic East Potomac Golf Links in Washington, D.C. Only days before, the judge had temporarily blocked the government from moving forward with the project.
During the hearing, which ended without a decision, Reyes chastised the government attorneys, who had previously told the court that renovating the links was still in its conceptual stage.
So when Trump posted his detailed plans for a new golf course on Sunday, Reyes wanted to know who was responsible for misleading the court.
"Do I believe the president of the United States or do I believe you?" she asked.
During the hearing, Reyes frequently exhibited frustration and annoyance.
"I have, on the one hand, the president of the United States saying to the American public three times now, I think, in the last two days, there is a final plan to redesign the golf course," she said.
"Then I have you all telling me and, you know, witnesses saying what they're saying, that there's no final plan.
Which is it?"
Trump has said that he wants to turn the three existing courses at the East Potomac Golf Links into a single, "championship-style golf course." But in February, a D.C. preservation group and two individuals challenged the U.S. Department of Interior and the National Park Service over the planned renovations, arguing that the renovated course would inflate tee-time costs for a facility that was originally intended to be "open to all people."
In May, the judge ordered the administration to give notice of any substantial construction work on the course, including the removal of more than 10 trees.
Despite the order, late on Friday, Oct.
9 — just before a holiday weekend — government officials notified the court that it planned to remove "up to 529 trees" in phases.
Bulldozers began taking down hundreds of trees the next day.
During a three-hour emergency hearing last week, Reyes called the government lawyers out for not giving enough prior notice for the tree removal.
She did not believe the argument that the tree felling was part of routine maintenance, saying she was "beyond disappointed" by the action and ordered a 24-hour halt.
"I do not know how I could have made it any plainer that I did not want what was to happen, to happen," she said, adding: "I have given the government every single benefit of the doubt that it would not do precisely what it has done."
On Friday, the White House filed a motion requesting that Reyes remove herself from the case, accusing her of bias.
The judge declined to step aside.
Ahead of the hearing on Monday, Trump wrote on Truth Social that Reyes was a "crazed lunatic" and said that renovation work did not need court approval.
"Work is scheduled to begin IMMEDIATELY!" he said.
The president's post appears to contradict a response filed by Department of Justice lawyers the previous day indicating that "the plan is not final because the Park Service has not completed its review."
Trump has described the golf course as "old, broken, dilapidated, and of no further use or effect." The prospect of a complete renovation has alarmed residents who are concerned about losing access to the historically affordable course and to the surrounding recreational area, which is popular with cyclists, runners, fishers and picnickers.
The century-old golf links were also one of the first public courses to be desegregated.
"This is not just some putt-putt course," Reyes told the attorneys, who appeared in court on Monday.
The park holds "a deep amount of meaning for the people of the district, and is protected as a historic landmark."
The White House has said that it is simply carrying out a 2019 preservation plan , but plaintiffs seeking to block the changes have said that Trump's stated desire to redevelop the course goes well beyond that.
Among other things, the 2019 plan recommends removing invasive vegetation that doesn't contribute to the historic landscape, but not healthy, native species.
The golf course is one of several instances in which the president has sought to circumvent the courts in order to exert his power and to place his own stamp on Washington, D.C. He has also threatened to tear down the Kennedy Center and is seeking to build a 250-foot arch near the National Mall .
JUANA SUMMERS, HOST: President Trump wants to turn a municipal D.C. golf course into a championship-style venue to the dismay of residents and the confusion of a federal judge.
Earlier this morning, President Trump said work on East Potomac golf course will begin immediately.
That was news to government officials and lawyers who testified in court today saying there is no final plan.
NPR's Rachel Treisman watched the six-plus-hour hearing and joins us now to catch us up on it all.
Hey there.
RACHEL TREISMAN, BYLINE: Hey there.
SUMMERS: So what stood out to you about today's proceedings?
TREISMAN: Big picture, the tone.
Judge Ana Reyes called this hearing a week ago in the hopes of getting more answers from government officials about the very abrupt clearing of hundreds of trees at East Potomac last weekend.
Now, that was the subject of a pretty tense hearing last Monday, where Reyes basically wondered aloud whether the government had been lying to her about its intentions at the golf course that Trump has publicly said he wants to redevelop.
So after that hearing, the government asked her to recuse herself.
They accused her of hostility and bias.
The judge denied that allegation and request.
So today's hearing mostly focused on questioning of three officials from the Interior Department and the National Park Service, but it definitely had its share of sharp exchanges between the judge and government lawyers.
At various points, she accused them of evading her questions and contradicting themselves.
But she made clear this wasn't pure frustration.
She was confused by the mixed messages she's been getting from this administration.
SUMMERS: So, Rachel, help us understand what exactly is going on at East Potomac, and what are the contradictions you mentioned?
TREISMAN: I wish we had six hours to get into it here, but I'll try to quickly summarize.
So Trump wants to overhaul this municipal golf course, and locals are worried that will make it less accessible and affordable.
That's why some of them sued back in February.
So all along, the Trump administration has said the plan was only in conceptual stages.
Judge Reyes at various points declined to intervene, instead warning the government they'd have to notify the court if they were going to take major steps - for example, cutting down more than, say, 10 trees.
Then last weekend, the administration cut down 430 trees, with less than a day's notice, over a federal holiday.
So officials with the Department of Interior and National Park Service are saying in court filings and hearings that they are acting on recommendations from this 2019 report.
Critics and Judge Reyes said that's a crazy coincidence - only some of the recommendations of the seven-year report are being followed, and only after Trump publicly set his sights on this very course.
SUMMERS: What does President Trump want to do to the golf course?
TREISMAN: We got some more hints yesterday when President Trump posted a rendering on Truth Social.
Still not a ton of detail, but critics have noticed two things so far.
For one, it would combine the area's three main different courses for different levels into one big, seemingly fancier one.
So there are questions about the accessibility for players of different skill and income levels.
And based on that one rendering, it looks this redevelopment would entirely eliminate the path that goes around the manmade peninsula that's really popular not just with golfers but runners and cyclists.
But again, it's not clear this plan has even been approved.
Trump said in his post yesterday, work will start on November 15 and keep the course closed for 15 months.
This morning, before the hearing started, he said it would begin immediately, and that surprised government lawyers and the National Park Service acting Director Jessica Bowron, who said she was not aware of any plan to close the course in November.
SUMMERS: I mean, there's a lot happening, and things are moving pretty fast, Rachel.
What are you watching for?
TREISMAN: Right.
So we got some details today about the tree-clearing part of things, but so many more questions about the government's future plans for the site and the process for it.
At one point, the judge literally asked the government's lawyer, should people believe what they hear from the president or from the agency?
So, of course, I'd like to see where the judge rules on this request to issue a restraining order.
She's already temporarily blocked the government from clearing more trees through next Monday, but we'll see whether she takes that any further in scope or in timing after today's hearing.
SUMMERS: NPR's Rachel Treisman, thanks.
TREISMAN: Thank you.
